Virgil Menefee: All of these things with the exception of the last four are part of the actual IEP and are required by law under IDEA. Suspension/expulsion regulations are addressed in the law, but are not in an IEP except in certain situations. The others are related to laws other than IDEA.2. IEP's: Our IEP meetings are held once a year as per federal law. The special education teacher prepares goals that are appropriate for the student and presents them to the team. She also addresses the LRE, accommodation/modifications, assessments, present levels of performance, strengths/weaknesses, behavioral issues, communications issues, physical needs, social/emotional needs, assistive technology, ESY, and transitional plans when age appropriate. The IEP team then agrees on whether these things are accurate and appropriate. The team is made up of the special educaiton teacher, general education teacher, SPED director, parent, student, principal. Parents can invite anyone t! hey feel can contribute to the meeting in a way that will benefit their child.3. LRE- This refers to where a student who qualifies for an IEP will get the bulk of their education. This means that the IEP must state what location, e.g. resource room, reg. ed room, that is best for the student. Special education students should be with their non-disabled peers as much of the day as possible. So, the LRE is the placement where the SPED student gets the instruction/accommodations they need, how much of the day is spent there, and why this has been decided upon. Potential harmful harmful effects from this placement are also addressed.5. Inclusion refers to having SPED students in the regular classroom for some, or all, of their classes. Many students with disabilities are able to progress academically in the regular education classroom with modifications, accommodations or supports.6.ESY is summer school. Tests are given before and after a long break over specific goals to ! determine if the student is retaining and remembering what the! y are working on. A student may require ESY if they have difficulty with the goal after failing the post-break test and re-teaching.4. FAPE is the law that requires that all students receive a public education that is appropriate to their needs. No child can be denied an education. This does not mean teacher requests.8. and 10. 504 and ADA sort of go together. The Americans with Disabilities Act was put in place to protect people with disabilities in from discrimination in the workplace and provides provisions for accommodations. 504 plans are for those who have identified needs/disabilities, but do not qualify for SPED services. 504 plans are not always handled by SPED personnel and many schools have a 504 plan specialist who handles them. They list accommodations/modifications for the student that are similar to those in an IEP.9. Suspension/expulsion No student can be suspended more than 10 school days or expelled for any action that is found to be a product of their disability. So if a student with a behavioral disorder has an outburst in class and needs to be removed from class, they can be suspended, as long as it is not the 11th time, because this action is a result of their disability. These students have behavior plans that determine how they will be disciplined and their goals relate to following rules and procedures appropriately. Now this same student can be suspended or expelled for bringing a weapon to school, as this is not a result of their disability. Many students who do not have behavioral/emotional disorders have behavior plans if they are doing things that are disruptive to the rest of the class.1.
